Terms and Conditions

1. Acceptance of Terms

By registering a school on Betterschool, or by accessing the Service as a staff member, teacher, student, parent/guardian, or visitor, you confirm that you have the authority to agree to these Terms — on your own behalf, or, if you are acting for a school, on behalf of that school. If you are using the Service on behalf of a student who is a minor, you confirm you are the student's parent or legal guardian, or are otherwise authorized by the school to do so.

2. The Service

Betterschool provides a configurable school management platform. Depending on the plan and modules a school enables, this may include: school directory and admissions pages, lead and visit tracking, student management, attendance, class and subject management, user management, homework, exams and exam routines, class routines and lesson plans, notifications and chat, events, leave management, fee management and receipts, expense tracking and the full finance system, analytics and insights, HR management, meeting tracking, incident management, surveys, school visit tracking, clubs/CAS, awards, library management, e-learning, bus tracking, height and weight tracking, birthday tracking, vaccination tracking, and student outing records, among other features we may add over time.

We may add, modify, or remove features at any time to improve the Service, and not every feature is available on every plan.

3. Accounts and Roles

Access to the Service is role-based. A school administrator creates and manages the school's account and grants access to staff, teachers, students, and parents/guardians as appropriate. You are responsible for:

• Keeping your login credentials confidential and secure.
• All activity that occurs under your account.
• Notifying us or your school promptly of any unauthorized use.
• Providing accurate information when creating or updating an account.

4. School Data and Responsibilities

Schools using Betterschool are responsible for the personal information they collect and enter into the Service about students, parents, and staff, including obtaining any consents required by applicable law (such as parental consent for younger students) before entering that information. As between Betterschool and the school, the school owns the data it inputs and is responsible for its accuracy, lawfulness, and appropriate use — including deciding which optional features (such as health, vaccination, or location tracking features) to enable.

Betterschool processes this data to provide the Service on the school's behalf, in accordance with our Privacy Policy and any applicable data processing terms agreed with the school.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Access or attempt to access data, accounts, or areas of the Service you are not authorized to access.
• Upload malicious code, or attempt to disrupt, overload, or reverse-engineer the Service.
• Misuse the chat, notification, or survey systems to harass, bully, or harm another user.
• Enter false attendance, exam, financial, or health records.
• Scrape, resell, or redistribute Service data without authorization.

6. Subscriptions and Fees

Some features of the Service are provided under a paid subscription billed to the school according to the plan selected at signup or as otherwise agreed. Fees, billing cycles, and renewal terms are as described on our Pricing page or in a separate agreement with the school. Unless stated otherwise, fees are non-refundable. We may change pricing prospectively with reasonable notice.

Where the Service is used to collect school fees from parents/guardians (e.g., through Fee Management or online payment features), those payments are processed by the relevant school and/or a third-party payment gateway; Betterschool is not a party to that payment relationship unless expressly stated.

7. Third-Party Services

The Service may integrate with or link to third-party services, including payment gateways, SMS/email/push notification providers, map and location services (for bus tracking), and analytics or advertising providers on our public marketing pages. We are not responsible for the practices, content, or availability of third-party services, and your use of them may be subject to their own terms and privacy policies.

8. Intellectual Property

The Service, including its software, design, branding, and content (excluding data you or your school submit), is owned by Betterschool or its licensors and protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, or lease any part of the Service. Schools retain ownership of the content and records they submit and are granted a limited, non-exclusive license to use the Service for their own internal school operations.

9. Availability and Changes

We aim to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. We may perform maintenance, make updates, or temporarily suspend access as reasonably necessary, and we will try to minimize disruption where possible.

10. Suspension and Termination

We may suspend or terminate access to the Service, in whole or in part, if a school or user violates these Terms, fails to pay applicable fees, or where necessary to protect the Service, other users, or comply with law. A school may stop using the Service or request account closure at any time; upon termination, we will handle remaining data in accordance with our Privacy Policy and any applicable agreement, including reasonable data export or deletion requests.

11. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet every requirement of every school, or that records generated through it (including attendance, health, or financial records) are free of user input error.

12. Limitation of Liability

To the fullest extent permitted by law, Betterschool will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or goodwill, arising from or related to use of the Service. Our total liability for any claim arising out of or relating to these Terms or the Service will not exceed the fees paid by the relevant school to Betterschool in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold Betterschool harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Service, violation of these Terms, or violation of any law or third-party right, including claims arising from a school's failure to obtain required consents for data entered into the Service.

14. Governing Law

These Terms are governed by the laws of Nepal, without regard to conflict-of-law principles, unless a separate written agreement with your school specifies otherwise. Any disputes will be subject to the exclusive jurisdiction of the competent courts of Nepal, except where applicable law requires otherwise.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above, and where appropriate, we will provide additional notice to schools. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
